On conscientious objection to abortion: Questioning mandatory referral as compromise in the international human rights framework

This article explores the approach of international human rights bodies to conscientious objection abortion, by requiring states implement mandatory referral mechanisms where is permitted. This, however, represents an inadequate compromise position as many objecting healthcare professionals also object and circumvent those requirements. Furthermore, cannot address broader issues with overuse misuse provisions which obstructs access abortion services. After considering harms caused suggestions for alternative regulatory responses, this proposes that framework should aim strike a contextual balance between freedom conscience ensuring abortion. new place clearer obligations on properly regulate objection, including socio-cultural stereotypes around motherhood foetus, result in widespread objection.
